A new cellphone video has surfaced in the case of a Texas man allegedly beaten to death by the husband of a Harris County Sheriff's Deputy in a Denny's parking lot.
The man who beat Hernandez saw him urinating outside the restaurant, according to the Harris County Sheriff's Office.
"An anonymous concerned citizen brought me the video because he said it shows murder", said criminal defense lawyer Jack Carroll, "I concur".
"If you continue recording, you will go to jail", one man tells the person recording the assault.
In the video, bystanders can be heard telling Thompson to stop. A family member told ABC News that Hernandez left behind a three-year-old child. However, how they rule is always a question of who and what grand juries believe, he added. "Let them take a look at it. Let other people decide what to do with this", Carroll said. Hernandez can be seen kicking his back legs and making audible sounds of struggle.
Randall Kallinen, an attorney for Hernandez's family, said authorities should make arrests based on the medical examiner ruling and the bystander-recorded video of the confrontation.
Investigators said the deputy's husband drove up to the restaurant at about 11:40 p.m. Sunday in the 17700 block of the Crosby Freeway.
Hernandez's wife says the police took her cell phone away before sending her to be interviewed about the events.
"When the deputy had observed that Hernandez had stopped resisting, she and her husband stopped restraining him, and then noticed that he was not breathing", Gonzales said. He's drunk.' He wasn't in any position to fight.
Hernandez was hospitalized after the fight and died three days later.
Hernandez's wife said her husband was drunk on May 28 after celebrating a sports team victory, reports CBS. "He was really angry".
The deputy allegedly called the sheriff's office for backup and emergency medical services before helping her husband restrain Hernandez, investigators said. The video, which is disturbing, is confirmation of a cover-up, according to the Hernandez family attorney.
Carroll played the video for reporters on Monday. When it was over, Hernandez was taken to a hospital and Thompson walked free.
However, he is the subject of the sheriff's office investigation, according to his lawyer Scot Courtney. He said the couple has received threats and cautioned against "the call for justice so quickly before we even have all the facts".
His wife says she had arrived separately from her husband and had attempted CPR on Hernandez.
Sheriff Ed Gonzales told reporters Friday that his department will conduct an investigation but has asked the Department of Justice and the Texas Rangers for help to ensure "transparency" and "another set of independent eyes".
