Though the ban never took effect, thanks to nationwide injunctions issued in Hawaii and Maryland, opponents have argued that the cases over the ban will become moot when the term expires. The only branch of the government that is acting outside its constitutional authority is the judicial branch, not the executive branch. Rather, they found that the president overstepped his authority on statutory grounds, meaning that the administration will have two fronts to defend if and when the matter reaches the Supreme Court.

The ruling given on Monday against the travel ban was yet another block against Trump's efforts to prohibit entry of citizens of Iran, Libya, Somalia, Sudan, Syria and Yemen for 90 days while the United States government reviews their screening procedures.

The White House released a memorandum Wednesday declaring that the effective date of the president's executive order banning travelers from six Muslim-majority countries "is delayed or tolled" until all relevant court injunctions "are lifted or stayed".

The government has already asked the high court to review a similar ruling last month from the 4th U.S. Circuit Court of Appeals in Richmond, Va.
