Google is still obliged to pay up despite the legal challenge, but it can put the money in a locked account until the court reaches a decision.

Google is required to stop the offending practices by September 28th or face additional fines that could amount to five percent of Alphabet's daily average worldwide revenue.

Google said it had no further comment. A court spokeswoman said Google has not asked for an interim order to suspend the decision to levy an fine.

The owner of the world's largest search engine said it filed its appeal on Monday at the EU's General Court, based in Luxembourg.

"The Commission's decision stands on firm ground, both legally and factually, and we expect the Commission to win on appeal", FairSearch lawyer Thomas Vinje said. "And most importantly, it denied European consumers a genuine choice of services and the full benefits of innovation".

The EU Court of Justice told a lower tribunal last Wednesday to re-examine United States chipmaker Intel's appeal against a 1.06 billion euro fine, dealing a rare setback to the Commission.

Google may take confidence on an unexpected reversal for Brussels last week when the European court of justice ordered a lower tribunal to re-examine Intel's appeal against a €1.06bn fine, the previous record for an anti-trust case.

The tribunal's press service said Google hadn't asked the court to suspend an European Union order for it to change how it displays shopping-search services before it rules on the challenge. These concern the contracts for its AdSense advertising service and the licensing of its Android mobile phone operating system.
