The Supreme Court nullified Kenyatta's August win over illegalities and irregularities and ordered for a fresh election scheduled Thursday.

His remarks came after opposition leader Raila Odinga withdrew from the repeat exercise and called on his supporters not to participate in the repeat polls.

The court hearing will occur even though Kenya's interior ministry has declared Wednesday and Thursday to be public holidays.

Philomena Mwilu was part of a majority of Supreme Court judges who voted to annul the re-election of President Uhuru Kenyatta last month, following the initial August vote.

IEBC chairman Wafula Chebukati's announcement that the election may not be credible has fulled calls that the exercise should be cancelled. The confrontations occurred amid bustling traffic and forced some city workers and passers-by to hurry away from clouds of tear gas.

"To postpone the elections outside of the constitutionally mandated timelines would legitimize violation of the Constitution and disobedience of Court orders and may fatally injure our delicate democracy", they said in their opinion.

On Tuesday, Odinga denied instructing supporters of the National Super Alliance to hold demonstrations during the repeat presidential election. Another electoral commissioner, Roselyn Akombe, has resigned, saying free and fair elections are not possible.

The petitioner can, however, move to the Supreme Court to have the matter addressed. She then fled to the United States, saying she feared for her safety.

It is important for the court to prevent a possible constitutional crisis by "ensuring that the fresh presidential elections are conducted in strict conformity with the constitution and applicable laws of Kenya", the petition says.

Those, who filed the petition are Khelef Khalifa, Executive Director of Muslims for Human Rights; Samwel Mohochi, Executive Director of the International Commission of Jurists; and Nahason Kamau.
