The Office of the Inspector General at the U.S. Department of Justice has referred its findings on former FBI Deputy Director Andrew McCabe to the U.S. attorney in Washington for possible criminal prosecution, according to a person familiar with the referral on Thursday. Andy McCabe lies four times to the Federal Bureau of Investigation, twice under oath to [Justice Department Inspector General] Michael Horowitz, nothing happens to him.

McCabe has a robust legal defense fund, if criminal charges are introduced related to him.

The IG's investigation centered on whether McCabe authorized the disclosure of the contents of a phone call he had with the then-principal associate deputy attorney general to Barrett, for an article, "FBI in internal feud over Hillary Clinton probe" on October 30, 2016.

Legal experts said Thursday that if the USA attorney's office in Washington were to open a criminal investigation into McCabe and he were charged with a crime, the charge would most likely be lying to the FBI.

On Wednesday, 11 House Republicans sent a letter to the Justice Department and the FBI calling for a criminal investigation into McCabe, Clinton, former FBI Director James Comey, former Attorney General Loretta Lynch, former acting Attorney General Sally Yates, FBI General Counsel Dana Boente, and two FBI officials, Peter Strzok and Lisa Page.

The move would escalate a feud between the Justice Department and the three GOP chairmen - Goodlatte, House Intelligence Chairman Devin Nunes and House Oversight Chairman Trey Gowdy - who have been demanding access to the Comey memos and other records from the Justice Department as part of their investigation into the FBI's handling of the Clinton email inquiry in 2016.

"We concluded that McCabe's decision to confirm the existence of the [Clinton Foundation] Investigation through an anonymously sourced quote, recounting the content of a phone call with a senior Department official in a manner created to advance his personal interests at the expense of Department leadership, was clearly not within the public interest exception", the inspector general's report said. The bureau was investigating the Clinton Foundation, the FBI attorney revealed for the first time to The Journal.

"It's not okay. The McCabe case illustrates what an organization committed to the truth looks like", Comey said and added, "I ordered that investigation". While at the FBI, McCabe played a pivotal role in the investigation into Clinton's emails.

After all his conversations with the president, Comey briefed McCabe and other aides.

"I still believe Andrew McCabe is a good person, but the inspector general found he lied", Mr. Comey said. McCabe asked the official: "Are you telling me that I need to shut down a validly predicated investigation?"

"We were advised of the referral within the past few weeks".

As I wrote when Comey began his gantlet of media interviews on Sunday, McCabe's media disclosure - and what Comey did or did not know about it - was one major area where Comey's honesty was sure to be questioned.

"I'm quite confident that didn't happen, as is the inspector general", Comey said.
